Terms & Conditions
These Terms & Conditions govern purchases made through the Woeste Wortel online shop. Mandatory consumer law remains applicable and takes priority over any conflicting provision.
1. Seller and scope
Woeste Wortel is the artistic activity of Robin Vandersteen. During the candidate-entrepreneur period indicated by Starterslabo, up to 24 September 2027, the activity is operated within the framework of Starterslabo Limburg & Vlaams-Brabant cv so - Starterslabo Limburg.

These terms apply to online orders for original artworks, drawings, art prints, stickers, apparel and other products offered through Woeste Wortel, as well as to commissions where these terms are incorporated into the commission agreement.
2. Product information and availability
We aim to describe products accurately, including relevant dimensions, materials, techniques, framing status, edition information and other key characteristics.
Original artworks are unique items. Once an original has been sold, it may no longer be available. If a stock or technical error results in an unavailable item being ordered, we may cancel the affected order and refund the amount paid.
Product photographs and digital mock-ups are intended to represent the product as accurately as reasonably possible. Screen settings, lighting, printing, production methods and material differences can cause slight variations in colour, scale, placement or appearance. Such normal variations do not affect mandatory conformity rights.
3. Handmade and artistic characteristics
Original artworks are handmade and may contain intentional or inherent marks of the artistic process. These can include texture, paint traces, raw or irregular edges, folds, creases, dog-eared corners, scratches, small tears, visible corrections and other studio traces.
When such a characteristic is part of the work at the time of sale and is visible and/or disclosed in the listing, photographs or condition information, it forms part of the artwork purchased. It is distinct from new damage that occurs after sale or during transport.
Prints, stickers and apparel may also show minor production variations between batches, including small differences in colour, print placement or finish, within reasonable production tolerances.
4. Prices and taxes
Prices shown to consumers are in euros unless otherwise indicated and include VAT where applicable. Delivery charges and any other additional charges are shown or communicated before the customer places the order.
For deliveries outside the European Union, import taxes, duties and customs or handling charges may be payable by the customer as described in the Shipping & Delivery Policy.
5. Placing an order and contract formation
By placing an order, the customer confirms that the information supplied is accurate and that they are authorised to use the selected payment method.
The customer is given the opportunity to review the order before final submission. The order becomes binding in accordance with the checkout process and order confirmation, subject to applicable consumer law and availability.
If an obvious pricing, stock or technical error is discovered, Woeste Wortel will contact the customer. Where an order cannot reasonably be fulfilled, the affected amount will be refunded.
6. Payment
Available payment methods are shown during checkout. Payment processing may be provided by Shopify and/or independent payment service providers. Their own terms and security measures may apply to the payment service.
Woeste Wortel does not normally receive or store complete payment card numbers when payment is processed by a third-party payment provider.
7. Commissions
A commission is an artwork created specifically in response to an individual customer request. The scope, dimensions, materials, artistic direction, price, deposit or payment schedule, feedback process and estimated completion time may be set out in a separate quotation or written agreement.
Unless expressly agreed otherwise, the artist retains artistic discretion within the agreed brief. Natural creative variation does not by itself mean that the work is non-conforming if the agreed essential specifications have been respected.
Because commissions are made to customer specifications or are clearly personalised, the statutory change-of-mind withdrawal right does not apply where the legal exception is met. Mandatory rights regarding defects or non-conformity remain unaffected.
8. Framing
Where professional framing is selected, Woeste Wortel arranges framing through an external professional company. Framing usually adds approximately 3-4 weeks to preparation. The frame specifications and additional price, where applicable, will be shown or agreed before confirmation.
Use of an external framer does not remove Woeste Wortel’s responsibilities to the consumer under mandatory law for the order sold by Woeste Wortel.
9. Delivery, returns and withdrawal
Delivery is governed by the Shipping & Delivery Policy. Returns and the statutory right of withdrawal are governed by the Refund & Returns Policy. Those policies form part of these Terms & Conditions.
Nothing in these terms limits rights that cannot legally be limited or excluded.
10. Statutory legal guarantee and conformity
Consumers are entitled to the statutory legal guarantee and conformity rights provided by Belgian and applicable EU consumer law. For new consumer goods, Belgian law generally provides a two-year legal guarantee for lack of conformity from delivery.
A characteristic or condition that the customer knew about at the time of purchase and that was properly disclosed as part of the specific artwork is not treated in the same way as an undisclosed lack of conformity.

11. Intellectual property and copyright
Unless expressly agreed otherwise in writing, purchasing a physical artwork, print, sticker, garment or commissioned work transfers ownership of the physical product only. Copyright and other intellectual property rights in the artwork, design, image or creative work remain with the artist or relevant rightsholder.
Customers may not reproduce, commercially exploit, manufacture copies of, mint as a digital asset, license, distribute or use Woeste Wortel artwork or designs for commercial purposes without prior written permission, except where applicable law permits such use.
Any separate transfer or licence of intellectual property rights must be expressly agreed in writing.
12. Website content
Text, artwork images, graphics, logos and other original website content are protected by applicable intellectual property law. Viewing the website does not grant a licence to reuse its content for commercial purposes.
13. Liability
Woeste Wortel is responsible in accordance with applicable law. Nothing in these terms excludes or limits liability where exclusion or limitation is prohibited by law, including mandatory consumer rights.
Woeste Wortel is not responsible for delays caused solely by customs, severe carrier disruption, force majeure or other circumstances outside reasonable control, but will communicate and perform legal obligations where such circumstances affect an order.
14. Governing law and disputes
These terms are governed by Belgian law, without depriving consumers of mandatory protections that apply under the law of their country of residence where such protections cannot be contractually excluded.
If a problem arises, please first contact info@woestewortel.com so we can try to resolve it directly. Consumers may also have access to the Belgian Consumer Mediation Service and, for eligible cross-border EU disputes, the European Consumer Centre.
15. Changes to these terms
We may update these terms when our services, fulfilment process or legal obligations change. The version applicable to an order is the version made available when the order is placed, unless mandatory law requires otherwise.
